The short version
Be who you say you are. Agree the terms on Kreati before work starts, then stick to them. Label sponsored posts. Kreati connects brands and creators and helps settle disputes, but the deal and the payment are between the two of you. Never pay anyone a fee to join or get picked.
01Agreeing to these terms
These terms are an agreement between you and Kreati (“Kreati”, “we”) for your use of Kreati. By creating an account or using the site, you accept them. If you are signing up for a brand, you confirm you are allowed to accept them on the brand's behalf.
Our Privacy Policy explains how we handle your data and forms part of these terms.
02Who can use Kreati
- You must be at least 18 and able to enter a binding contract.
- The information you give us, including your name and brand details, must be true and kept up to date.
- One account per person or brand. Do not sign up as someone else or share your login.
- You cannot use Kreati if we have previously banned you.
03Your account
You are responsible for what happens under your account and for keeping your password safe. We recommend turning on two-factor authentication in Settings. Tell us straight away at support@kreati.app if you think someone else has access.
04What Kreati does and does not do
Kreati is a marketplace. We help brands and creators find each other, agree terms in writing, exchange messages and deliverables, and resolve disagreements. The collaboration itself is between the brand and the creator.
- We are not an agency, employer or agent for either side, and creators are not our employees.
- We do not guarantee that a campaign will be filled, that a creator will be hired, or any result.
- We check some information, such as numbers from connected social accounts, but we do not vet every user, campaign or claim. Use your own judgement.
05If you are a creator
- Your profile must represent you. Do not claim audiences, results or partnerships you do not have.
- Only connect social accounts you own or manage. Do not inflate numbers with bought followers, engagement groups or bots. Verified numbers come from the platforms, and tampering with them is grounds for a ban.
- Deliver what you agreed, by the date you agreed, or talk to the brand before the deadline.
- Label sponsored content. You must follow the advertising disclosure rules where you and your audience are, and the rules of each platform, for example by using the platform's paid partnership label or a clear #ad.
06If you are a brand
- Campaigns must describe real work, a real budget and lawful products or services.
- Do not ask creators to make false or misleading claims, hide that content is sponsored, or break a platform's rules.
- Review deliverables in good faith and give reasons when you ask for changes or reject work.
- Pay creators what you agreed, when you agreed.
- Only use content within the usage rights in your agreement.
07Agreements and payment
Before work starts, both sides confirm an agreement on Kreati covering the deliverables, fee, due date, number of revisions, and how and for how long the brand may use the content. Either side can propose changes, and nothing changes until both sides confirm. Kreati keeps every version.
That agreement is a contract between the brand and the creator. Kreati is not a party to it.
Kreati does not currently process, hold or transfer payments. The brand pays the creator directly, as set out in the agreement. Each side is responsible for its own taxes, invoices and registrations.
Kreati will never ask you for a registration, verification or processing fee, and neither should anyone you meet here. Treat any such request as a scam and report it.
08Your content
You own what you post on Kreati: your profile, photos, portfolio, messages and deliverables. You give Kreati a worldwide, non-exclusive, royalty-free licence to store, display and share that content only to run Kreati, for example to show your public profile and let the other side of a collaboration see your work. This licence ends when you delete the content or your account, except for records we keep anonymized as described in the Privacy Policy.
What a brand may do with a creator's deliverables is decided by the usage rights in their agreement, not by this section.
You must have the rights to anything you upload, including music, images and other people who appear in it.
09Things you must not do
- Harass, threaten, or discriminate against anyone.
- Scam, impersonate, or ask for payment or personal details under false pretences.
- Post anything illegal, sexually explicit, hateful, or that infringes someone else's rights.
- Leave fake reviews, or trade reviews for anything.
- Collect data from Kreati by scraping, bots or bulk downloading, or use other people's contact details for anything outside a collaboration.
- Try to get into accounts or parts of Kreati you should not, or disrupt the service.
- Use Kreati to send spam or unsolicited advertising.
10Reviews
After a collaboration, each side can review the other. Reviews must be honest and about that collaboration. We may remove reviews that break these terms, but we do not remove reviews just because they are negative.
11Disputes between brands and creators
If a collaboration goes wrong, for example work is not delivered, is late, does not match the agreement, or payment is in question, either side can raise a dispute on Kreati. Try to sort it out in the chat first.
A Kreati moderator reviews the agreement, the deliverable and the conversation, and records a decision, such as asking for the work to be resubmitted or finding that the creator should be paid. You agree to engage honestly with the process.
Because Kreati does not hold funds, a moderator's decision is not a court judgment and does not stop either side from using other legal remedies. It can, however, affect reviews and lead to action on accounts.
12Moderation and enforcement
We may review reported chats, and automated checks warn people about likely scams. If you break these terms, we may remove content, warn you, suspend your account for a period, or ban it permanently. Where it is safe to, we will tell you why.
If you think we got it wrong, reply to the notice or email support@kreati.app and we will look at it again.
13Instagram, YouTube and TikTok
Connecting a social account is optional. When you do, you also agree to that platform's own terms, including the YouTube Terms of Service for YouTube. We are not responsible for those platforms, their availability, or changes that stop us reading your numbers.
14Leaving Kreati
You can delete your account at any time from Settings. It is removed after 14 days, and you can cancel during that time. Finish or settle any active collaborations first, since leaving does not cancel what you agreed.
We may suspend or close accounts that break these terms, or stop offering Kreati altogether. If we close Kreati, we will give reasonable notice so you can download your data.
15Disclaimers
We work hard to keep Kreati running and accurate, but it is provided “as is” and “as available”. To the extent the law allows, we do not promise it will always be available, error free, or that numbers pulled from other platforms are complete, and we are not responsible for what users say, post, deliver or pay.
16Limits on our liability
To the extent the law allows, Kreati is not liable for indirect or consequential losses, such as lost profits, lost deals or lost data, or for disputes between users. Our total liability to you for any claim is limited to the greater of the amount you paid Kreati in the 12 months before the claim, or 100 US dollars.
Nothing in these terms limits liability that cannot be limited by law.
17Your responsibility to us
If someone makes a claim against Kreati because of content you posted, a collaboration you entered, or your breach of these terms or the law, you agree to cover Kreati's reasonable costs of dealing with it.
18Changes to these terms
We may update these terms as Kreati changes. We will change the date at the top, and tell you by email or in the app before any change that affects your rights takes effect. If you keep using Kreati after that, the new terms apply. If you do not agree, you can delete your account.
